Terms & Conditions for Commercial Cleaning

1. Definition and Interpretation
- Interpretation of the following words used in these TOCs:
- “House Boss”, “Company”, “us”, “we”, “our” means Clean On Limited.
- “Cleaning services” means the standard cleaning services as indicated in the Quotation, Proposal or email communication.
- “Cleaner”, “Cleaning Operative” – understood as the technician or firm / contractor providing cleaning service on the behalf of the Company.
- “Customer” or “you” or “your” means the person, firm, company or organization to whom the cleaning service are supplied by the Company.
- “Customer’s Address” – understood as the exact address where the Client wants the cleaning job to be arranged.
- “Area” means the area at the address specified in the Quote, Proposal or email communication.
- “Parties” means the Company and the Client, and “Party” shall mean either one of them.
- “Specification” means the specified Cleaning Services.
- “Other Charges” means charges for Additional Services.
- “Contractual Term” means the period during which the Company shall provide the Cleaning Services and any other Services as identified in the Contract and Proposal and/or the Specification.
- “Quotation” means our quotation for the provision of Cleaning Services.
- “Charges” mean the amounts set out for the cleaning service as specified in the Quote or any subsequent Agreements.
- “Cleaning Visit” – understood as when an operative goes to the customer`s house/flat so he/she can provide the needed cleaning.
- “Additional Services” means any additional services not included in the Quote and that must be agreed upon by the parties.
- “Commencement Date” means the date set out in the Specification.
2. Contract
- These TOCs are applied as a contract between Clean On Limited and the Customer. If the Customer places an order by phone, WhatsApp chat, or website forms for request, it will be considered as the Customer is agree and accept our TOCs.
3. Cleaning Services
- Cleaning Services will be provided in a proper manner for the Customer at the Area at the address specified in the Quote, Proposal or Email communication.
- All cleaning products and equipment can be provided by the Customer. House Boss can also provide all cleaning equipment and products for an additional charge.
- The Company shall supply competent workpeople with the numbers required, suitable for the types of work to be carried out. The machines and materials used to undertake the cleaning services shall be in good condition and suitable for use in performing the work. All the electrical equipment shall be regularly tested and approved by qualified electricians supplied by Clean On Limited
- All materials used or supplied by Clean On Limited shall comply with the European Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures.
- The Company will regularly conduct its Quality Management System as regard work to be performed within the site with the rules, regulations, and requirements in force for the time being.
- The Company shall undertake positive identification and Security Vetting, as set out in the communication, on all its subcontractors attending the Customer’s premises.
- The Company will maintain its Environmental Management System and Health & Safety Management System.
4. Use of Subcontractors
- We may use a sub-contractor to provide some of the Cleaning Services and/or any Additional Services where appropriate.
- We will be responsible for the work of a sub-contractor to the same standard as stated in the Agreement and the Specification or as agreed by the Parties.
5. Your Obligations
- The Customer shall provide free of charge light, water and other facilities which required to provide the Cleaning Services.
- Suitable and safe place for storing such equipment and materials left by the Company.
- The Customer agrees to pay any additional charges related to delays in carrying out the work or cancellations because of the Customer’s failure to allow access or provide proper instructions.
6. Quotation
- The Company forms and shares a quote after receiving a request from the Customer and this quote could be approved and proceeded with for a period of 30 days after firstly creating it.
- We are authorized to accordingly change / amend the price provided if the client changes his/her requirements.
- If there is some difference in the price, which is more than 10%, it will be discussed with the customer before starting with the job.
- The Customer is provided with an estimate time based on the average time it takes to perform a chosen cleaning service for a property of similar size as it is very difficult to estimate precisely how long such tasks may take so a degree of flexibility may be required.
7. Vat
- The charges quoted are exclusive of VAT which will be added to the amounts charged at the applicable rate.
8. Charges
- If the Charges are increased, you will be notified by giving 14 days’ prior notice, provided that:
- The increase will be made within the initial 12 months of the Agreement.
- You may terminate the Contract by giving 3 months’ notice in writing within 14 days following such notice of increased Charges.
- If we do not receive any notice from you, it will be considered as the acceptance of the increase of Charges.
- The Charges may be increased due to the increase in the cost of providing the Cleaning Services and because of changes in relevant laws and regulations.
- The Charges may be increased based on yearly increases of The London Living Wage (LLW). To increase the amount of London Living Wage paid to employees and contractors by the amount of any increase to the London Living Wage as announced by GLA within 3 months of such an announcement.
9. Payment
- The payment needs to be made by bank transfer.
- Invoices will be submitted at the end of each month’s calendar and will be due for payment within 30 days of submission.
- The Company is authorized to apply an additional fee for non-paid Invoices with more than 30 days and to amend the rate of 8% per annum above the Bank of England base rate under the Late Payments Act. from the outstanding amount accruing daily and subject to a minimum rate of 5.5%
- Or payment in advance will be required for any Cleaning Services (or any part of Cleaning Services) or any additional services which have not been performed yet;
- Or no further Cleaning Services (or any part of Cleaning Services) will be provided.
- Breach of agreement
- If you do not make payments that you owe in relation to any services provided to you by Us, we may disclose your personal data to credit reference agencies and to fraud prevention agencies for the purposes of fraud prevention. We may also disclose your personal data to debt collection agencies which may use your information to trace your whereabouts and recover the debts. The information which we provide to such agencies may in turn be provided by those agencies to other organisations which may use your personal data to perform similar checks. Information recorded by fraud prevention agencies may be accessed by organisations in other jurisdictions.
10. Claims
- The Company cannot be held responsible for any loss or damage unless notified in writing within two working days of the event that may give rise to a claim, as any delay makes an investigation difficult.
- Also all surfaces like granite, marble, wood and so on are presumed to be prepared for cleaning (sealed) without causing any harm.
- We will not be liable for damage to crockery or glassware arising during the collection or washing up of these articles.
- We will not be liable for the disposal of any items placed in, under or on wastepaper or rubbish bins.
- Our Company will not take any responsibility for losses, expenses, damages, delays, costs or compensation (either direct, indirect or consequential) arising from or in any way connected with.
- It is impossible to provide services due to factors that are not under our control. Factors include but not limited: floods, weather condition, and inability to get access to the property, lack of water, electricity, and lighting.
- Third party entering or present at the Customer’s premises during the cleaning process;
- An existing damage to Customer’s property in the form of old stains/burns/spillages etc. which cannot be cleaned/removed completely by the Cleaner using the Customer’s cleaning equipment and materials;
- We cannot be held liable if any stains or dents on the carpets cannot be removed. The Customer understands and agrees that some stains cannot be removed completely. We do not have any responsibility to provide further cleaning or refunds in case any stains cannot be removed.
- Any damages worth £300.00 or less.
11. Supplementary terms
- If the Customer would like their key to be collected by our cleaners from an address that is a different Post code from the booked one, then a £10.00 fee will be added. If the collected key should be returned to the pickup address or any other address, an additional charge of £ 10.00 will be applicable.
- The Customer is provided with an estimate time based on the average time it takes to perform a chosen cleaning service for a property of similar size as it is very difficult to estimate precisely how long such tasks may take so a degree of flexibility may be required.
- Accordingly to the Health and Safety regulations, our Cleaners will attempt to move furniture that require no more than one person to lift/move them freely.
- In case if our cleaners can’t perform their task, the Company will provide a replacement as soon as possible. The Customer will be accordingly informed in advance.
- The Company leaves the possibility to change any part of these TOCs without giving any prior notice.
12. Liabilities
- If the Cleaning Services (or any part of them) or any Additional Services will be performed negligently or materially in breach of the Agreement or the Specification, then, if requested by you, these will be re-performed. The Client’s request must be made within two working days of the date of performance of the Cleaning Services and/or any Additional Services in question.
- Employers Liability Insurance with a Limit of Indemnity of £5,000,000.
- Public Liability Insurance, including Products Liability and Treatment Risks with a Limit of Indemnity of £10,000,000.
13. Termination
- Either Party may terminate the Agreement, at any time, on written notice to the other Party no less than 2 weeks’ notice. At the end of the contract, this Agreement will be automatically renewed subject to a two weeks’ notice period by either party.
- We leave the right to cancel or terminate the contract if no cleaner can be allocated due to availability, wage paid by the Customer, time of the day or day of the week.
- The Customer shall not contact or hired within the period of one year after termination of the contract any person who during the term of the contract has been a cleaner of HOUSE BOSS involved directly or indirectly in the provision of the service for the Customer. The Client is liable to a fee equivalent to 50% of the current annual Cleaner’s paid to Clean On Limited.
14. LAW
These TOCs are governed by the Laws of England.
These TOCs are subject to the exclusive jurisdiction of the Courts of England.
These TOCs are in regulation of the Consumer Rights Act 2015 and are not in imbalance in the parties’ rights or obligations under the contract.
The Terms are transparent for the purposes and expressed in plain and intelligible language and are legible.
The Terms are prominent for the purposes of the section and brought in such a way that Customers would be aware of them.
15. TRADEMARKS
The House Boss name, logo, and company names, and other logos are trademarks of Clean On Limited. The use of any Marks or any other materials contained on the Website without the prior written permission of their owner, will be considered as prohibited.
